These Terms of Service ("Terms") govern your use of vandycktraining.com and all services provided by Van Dyck Training ("VDT"), operated by Sebastian Van Dyck. By accessing or using VDT, you agree to these Terms in full.

1. Eligibility

You must be at least 18 years of age to use VDT services. By using this platform, you represent and warrant that you meet this requirement. Accounts found to belong to users under 18 will be terminated.

2. Nature of Services

VDT provides subscription-based online fitness programming designed by Sebastian Van Dyck, DPT. While Sebastian holds a Doctor of Physical Therapy credential, that credential informs the quality and design of programming — it does not create a patient-provider relationship of any kind.

VDT services are not physical therapy, medical treatment, rehabilitation, clinical care, or medical advice. No healthcare provider–patient relationship is formed by your use of this platform. You should consult a qualified physician before beginning any exercise program.

3. Waiver and Assumption of Risk

Your use of VDT is subject to our Liability Waiver, Assumption of Risk, and Terms of Use, available at vandycktraining.com/waiver, which is incorporated into these Terms by reference. By using VDT, you acknowledge that you have read, understood, and agreed to the Waiver. You assume all risks associated with participation in fitness programming, including risks arising from the negligence of VDT.

4. Subscription and Payment

Access to VDT programming requires a paid subscription. By subscribing, you authorize recurring charges to your payment method at the applicable subscription rate. All payments are processed securely through Stripe.

5. Liability and Release

To the fullest extent permitted by law, VDT's liability to you for any claim arising from your use of this platform is limited to the greater of: (a) the total subscription fees you paid in the three months preceding the claim, or (b) $1.00.

VDT is not liable for indirect, incidental, consequential, or punitive damages of any kind. Nothing in these Terms limits VDT's liability for gross negligence or intentional misconduct.

6. Intellectual Property

All programming, content, materials, and intellectual property provided through VDT are owned exclusively by Van Dyck Training. You are granted a limited, non-transferable license to access content for your personal use only. You may not:

VDT reserves the right to suspend or terminate your account at any time for violations of these Terms, without refund.

8. Privacy

Your use of VDT is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Modifications

VDT may update these Terms at any time. Material changes will be communicated via email or through the platform. Continued use of VDT services after any modification constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Maine, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the State of Maine, and you consent to personal jurisdiction and venue in those courts.
